Project to create an energy cooperative in the Stawiski commune – regulatory sandbox

On June 25, Paweł Pisarczyk will speak at the KlastER conference in Krakow, where, together with the mayor of the Stawiski commune, Agnieszka Rutkowska, he will present the concept and plan for creating an energy cooperative.

It is expected that the launch of an energy cooperative will bring many benefits and will contribute, inter alia, to to reduce energy costs incurred so far by members of the cooperative, intensify the use of renewable energy, improve the image and attractiveness of the commune for new investors, secure energy needs for new enterprises that locate their factories in the commune due to the development of Via Baltica, improve the quality of life of households improving the quality of the natural environment, increasing the energy security of the region, as well as creating new jobs and creating new services at the local level.

Research and technology is not followed by legislation. The currently functioning legal bases for Energy Cooperatives are limited to the act on renewable energy sources. Pursuant to the Act: “14. The minister responsible for climate matters, in consultation with the minister responsible for rural development, shall determine, by way of a regulation:

1) the detailed scope and method of recording the measurement data and balancing the amount of energy referred to in par. 5,

2) a detailed method of making the settlements referred to in para. 6, taking into account the prices and rates of fees in individual tariff groups applied to the Energy Cooperative and its individual members,

3) the detailed scope and method of making the measurement data referred to in par. 5, between energy enterprises and between energy enterprises and an energy cooperative,

4) detailed subjective scope of the Energy Cooperative – bearing in mind the need to standardize the method of making settlements and the protection of their interests, as well as the safety and reliable operation of the power system “

Until now, none of the above points have been defined under the regulation in force in law. The method of settling the cooperative described in the draft ordinance of the Minister of Climate on the registration, balancing and sharing of measurement data and settlements of energy cooperatives drawn up in May 2020 is still at the stage of giving opinions. In view of the current legislative situation, the only way to establish an energy cooperative is to use a regulatory sandbox, which will enable identification of the real needs and problems of cooperatives, energy sellers and distribution system operators, whose cooperation and mutual benefit are required for the functioning of the cooperative.

During the conference, the benefits of establishing an Energy Cooperative and a simulation of savings for the Stawiski commune will be presented.
